Corporate disputes are a separate profession today” – comments Dr Radosław L. Kwaśnicki, President of the Management Board in the RKKW Law Firm. “Over a decade ago, when I defended my PhD dissertation on the corporate law and when I established the RKKW Law Firm, corporate disputes happened much less frequently but even then they were already quite an emotive topic. The emotions, also due to the digital development of the media, are sometimes greater today than they were in the past. Since then – I can say without exaggerated modesty that it was with our considerable contribution – a certain separate specialisation in <corporate wars> developed among law firms. In the RKKW Law Firm we have such very department that is composed of more than ten associates who can bring under control any crisis corporate situation.” ­– explains Dr Kwaśnicki.

 

The first serious <war> with our participation was the defence of Herbapol Wrocław against a hostile takeover. The case which started in 2007, super interesting – in terms of its business and legal aspects – ended with our Client’s (Herbapol’s) success and notorious judgments of the Supreme Court starting from 2011. It required a non-standard approach which was initially rejected by courts of lower instances but which was appreciated by the Supreme Court (which was followed by many common courts). Finesse is the quintessence of corporate disputes – any clichés are doomed to failure. I also pass on this truth to my Students and we go into battle with a lot – and recently even more – of work to be done.” – sums up Dr Radosław Kwaśnicki.
